Abstract:The web crawler technology, considering its wide use, has become one of the main tools for infring? ing citizens’personal information. In order to properly protect the information right of citizen, it is urgent to im? pose criminal regulations on such behaviors. By using the method of literature review, this paper studies the ille? gal provision of web crawler technology. It can be found that the improper infringement of citizens’personal in? formation by web crawler technology can be effectively regulated by providing the application of procedures and tools for intrusion and illegal control of computer information systems. The identification of the crime of provid? ing intrusion and illegal control of computer information systems and tools needs to pay attention to the behavior type requirements of this crime. At the same time, the key to judge the illegality of the criminal law of the appli? cation of crawler technology is whether to obtain the consent of the crawled party. The nature of web help pro? viding crawler technology is equivalent to the criminalization of help, but it needs to be examined in the essence of infringement of legal interests. Considering the substantive criminal law, it should be explained by the nature of network help behavior from the perspective of imputation theory.
