Abstract:The Criminal Law Amendment (11) makes it a crime of illegal medical practice that the embryo edit? ed by gene or cloned embryo is implanted into human or animal body with serious circumstances, which is still open to discussion. When the Criminal Law intervenes to regulate gene-editing behavior, it should be subject to criminal regulations that only gene-editing behaviors of germ cells are not for medical uses and seriously endan? ger society, on the premise of identifying the mechanism and social consequences of gene-editing technology be? havior. To regulate human embryo gene crimes and maintain the applicability and stability of the Criminal Law, the crime of human embryo testing should be added to clarify the criminal boundary.
