Abstract:Traditional international aviation security convention mainly contains conventions and protocols against unlawful acts that threaten the safety of international civil aviation, including the 1963 Tokyo Conven? tion, the 1970 Hague Convention, the 1971 Montreal Convention and the 1988 Montreal Protocol. In order to strengthen international cooperation, the 2010 Beijing Convention and Protocol improved extradition rules by excluding offences in the convention from political offences and adding human rights provisions. But there are still problems in how to achieve the balance with sovereignty and human rights, and the difficulties in determin? ing the obligation to prosecute. Therefore, we can perfect the extradition rules by improving the formulation of the provisions, comprehensively considering the substantial grounds and promoting the domestic legal systems.
