Abstract:As for the inheritance of rural land rights and interests, the academic circle has been disputing constantly, and there is no conclusion. However, the new three-power structure provides a new way to solve this problem. Under the separation of powers, the land management right does not have the personal attribute and the right subject is not the farmer. It conforms to the provisions of our inheritance law and should be inherited. This is also reflected in the specific provisions of the new law. And in the process of succession, the successor of the land management rights can be an internal member of the collective or an external member of the collective. However, if the right of management is expired, the successor in the collective should be given priority considering the stability of the land.
