Abstract:The purpose of the outsider’s objection suit is to mitigate the supremacy of efficiency that executive procedure abides to. The standard of“Sufficiency of Excluding the Enforcement of Civil Rights and Interests” involves both substantive and procedure laws. Among these cases, title house in another’s name and shareholding entrustment behaviors are typical and of great significance. Judgment of the act on behalf of the law“enough to exclude enforcement”needs to consider the priority of substantive law rights, the trust interest of the applicant and the priority of enforcement of creditor’s rights. In principle, the anonymous rights holder does not enjoy“enough civil rights to exclude enforcement”, but when it comes to the protection of survival interests and the enforcement applicant does not have a trusting interest, it can be given an exclusion force exceptionally.
