In the implementation of civil-military integration strategy, the civil transformation of national defense patent is of vital significance. National defense patent is concerned with national defense interests or has a potential role in defense construction. The current national defense patent legal system has such problems as unclear ownership, low efficiency of secrecy and deciphering mechanism, and insufficient compensation of national defense patent. The legislation should establish a clear-owned patent system including on-duty invention, cooperative invention, and commissioned invention, reform the mechanism of secrecy and decryption ossification of national defense patent, and improve the mechanism of compensation for defense patent gains.
